Our Contract
These Terms and Conditions govern the supply of goods sold by MCD Garden Sheds Ltd of West Curragh, Naul, Co.Dublin (“we” and “us”) to the customer (“you”) and constitute the entire and only agreement between us in relation thereto. Company Reg. No: 617990, Company Vat No: 3523988DH
All orders placed through our online shop are subject to these Terms and Conditions. A legally binding contract between you and MCD Garden Sheds Ltd is only formed when we deliver the goods to you. Please note that the processing of your payment and the acknowledgement of your order do not constitute legal acceptance of the order.
MCD Garden Shed Ltd provides its services to you in accordance with the terms, conditions, and notices outlined in this agreement. When you use any of our services, including placing orders, you are also subject to any additional rules, guidelines, or policies that apply to those specific services. All such policies are incorporated by reference into these Terms and Conditions.
We reserve the right to update, modify, or change this website, its contents, and these Terms and Conditions at any time without prior notice. By accessing, browsing, or making a purchase on our website, you agree to be bound by the most current version of these Terms and Conditions. We encourage you to review them carefully before placing an order.
Price & Payment
The price payable for the goods you order will be the price displayed on our website at the time of your order, plus any applicable delivery charges, which will be communicated to you during the checkout process.
Please note that promotional offers and discounted pricing are not available when using third-party finance options. If you choose to finance your purchase through HUMM, standard full pricing will apply.
We make every effort to maintain accurate and up-to-date pricing. Once your order has been confirmed and accepted, the price stated will not change unless:
Your order is not scheduled for delivery or collection within six (6) months of the deposit payment, or
There is a material increase in the cost of raw materials outside our control. In this case, we will contact you with details, before any production. A full refund will be available if the increase of materials is not suitable.
In such cases, we will contact you in writing with the revised price and give you the option to proceed, modify your order, or cancel with a full refund of any deposit paid.
We are under no obligation to accept your order and may, at our discretion, decline the order or limit the quantity of goods supplied.
From time to time, we may offer promotional pricing. In order to benefit from such offers, you must enter the relevant promotional code at checkout. Failure to do so may result in being charged the full standard price.
Promotional discounts apply only to pre-designed products such as garden sheds, garden rooms, garden storage, and furniture. Bespoke designs or customized builds are not eligible for promotional discounts unless explicitly stated. Please also note that discounts are not cumulative; only one discount code or offer may be used per transaction.
While we strive to ensure that all pricing information is accurate, pricing errors may occasionally occur. In such cases, we are not obligated to supply goods at the incorrectly advertised price and will inform you of the correct pricing before proceeding with your order.
Full payment of the product price, including any applicable delivery or installation charges, must be received in full before your order will be scheduled, or dispatched.
You may not withhold payment unless you have a valid and unresolved claim relating to the goods or services provided, as permitted under Irish consumer protection law. This does not affect your statutory right to seek redress or compensation for defective or non-conforming goods.
We may, where legally permitted, apply any refund or compensation owed to you against amounts you owe us under this or other contracts. We will notify you in writing before making any such adjustments and ensure that your statutory rights are not affected.
The format of our invoices and account statements is determined solely by us. We do not accommodate changes to our invoicing format under any circumstances.
Where a “Was” price is displayed on our website, it reflects the product’s previous selling price for a continuous period of at least 30 days prior to the current reduction, unless otherwise stated.
Payment Security Policy
For your protection and ours, all payments over €3,000 must be made via bank transfer. We do not accept credit cards or debit cards for amounts exceeding this limit. Bank transfer details will be provided, and confirmation of payment must be received before scheduling construction.
Deposits and Pricing Policy
Any deposit paid will be valid for a maximum period of six (6) months from the date of payment. Delivery must be arranged within this period unless prior written approval has been obtained from management.
Please note that if there is a delay in delivery over six (6) months, all prices are subject to change without notice due to fluctuations in material costs. We reserve the right to amend pricing accordingly at any time prior to final payment and delivery.
Delivery Timeframes
We aim to deliver your items in accordance with your order and within the stated delivery lead times. Please note, a valid signature will be required upon delivery or collection. If you do not receive your order within the expected timeframe, you must notify us immediately.
We strongly advise that you do not schedule or commence any installation work until your order has arrived and you have checked all items for completeness and any defects.
Delivery Location & Conditions
Deliveries are made to the exterior of a ground floor location at the address provided at the time of order, unless prior written approval is obtained from management. We do not deliver to upper floors, basements, or through buildings unless explicitly agreed in advance. It is the customer’s responsibility to ensure clear access for delivery.
Missed or Delayed Deliveries
You are responsible for ensuring that delivery can take place at the agreed time and location. If delivery is delayed or fails due to circumstances within your control, we will make reasonable efforts to arrange a new delivery within 30 days. Any additional delivery charges resulting from a failed attempt will be your responsibility.
If we are unable to reschedule delivery, we may cancel your order and issue a refund for the goods, minus any delivery charges incurred.
Ownership & Risk
Once full payment has been received and your garden shed has been delivered to the address provided, risk transfers to you. From that point forward, you are solely responsible for the shed’s safekeeping, protection from weather, theft, loss, or damage.
MCD Garden Sheds Ltd shall not be liable for any damage, deterioration, or loss occurring after delivery, whether or not the shed has been installed.
Flat-Packed Shed Deliveries
For flat-packed garden shed deliveries, the shed will be delivered in component form to the exterior of a ground floor location at the delivery address provided, unless prior arrangements have been made and confirmed in writing by management.
It is the customer’s responsibility to:
Ensure there is adequate access and a suitable space to receive and store the flat-packed components;
Inspect all parts upon delivery and report any missing or damaged items within 48 hours;
Store the components safely and in a dry area until assembly;
Arrange for assembly by a qualified person, if not opting for our installation service.
MCD Garden Sheds Ltd is not responsible for assembly errors made by third parties or the customer, or for damage incurred after delivery due to improper handling or storage.
Shipping & Collection Options
We currently ship orders only to billing addresses. If you require delivery to a different address, please contact us before placing your order to make alternative arrangements.
If you choose our Free In-Store Collection option, you must present both a copy of your order confirmation and valid photo identification (passport or driver’s licence only) upon collection. In-store collection is available free of charge for all online and phone orders.
If you choose the Free In-Store collection option, you are responsible for arranging collection using a suitably sized vehicle appropriate for the dimensions and weight of the shed purchased.
You must:
Ensure the vehicle used is capable of safely transporting the shed or its components;
Bring appropriate loading equipment or assistance, if needed;
Collect the goods at the agreed time and location.
MCD Garden Sheds Ltd accepts no liability for damage caused during loading, transit, or unloading when the customer arranges their own collection. Once the goods have been handed over, risk transfers to you immediately.
Electrical Installation – Garden Builds
First Fix Electrics refers to the installation of wiring by MCD Garden Shed Ltd fitters on the day of the garden build. This includes the placement of wiring either behind or beside the insulation before the internal finish is applied. If you do not opt for an internal finish through MCD Garden Shed Ltd, the wiring will remain exposed and MCD Garden Shed Ltd will not be able to complete the second fix.
Second Fix Electrics involves the installation of fixtures such as sockets, switches, and LED downlights. This work is carried out by our recommended electrician and typically takes place three to four days after internal finishes are completed, under condition of being within the free delivery area. Charges apply for our recommended electrician to areas outside of this zone.
Please note: MCD Garden Shed Ltd is responsible for wiring the garden build only. We are not responsible for connecting the build to your house or mains electricity supply. This connection must be arranged separately by you, either with your own electrician or with our recommended electrician during their site visit.
Bespoke Orders
Where the Customer places an order for bespoke or specialist manufactured goods, including but not limited to Garden Sheds, Timber Garden Products, Pergolas, or any other custom-made items (“Bespoke Order”), the following cancellation terms shall apply:
In the event of cancellation by the customer of bespoke orders:
For bespoke or custom-made products, a non-refundable deposit of up to thirty percent (30%) may be required to cover the costs of design, material procurement, and preparation.
If you cancel before any work has begun, we will refund your deposit in full.
Once production has commenced, all or part of the deposit may be retained to reflect actual costs incurred. You will be informed of any non-refundable amount based on the stage of completion at the time of cancellation;
In the event that the Customer makes a claim relating to a manufacturing fault, the Customer may be required to provide photographic evidence via email or post to the Company’s Customer Services department.
Upon receipt of such evidence, the Company shall review the claim and make a commercial decision at its sole discretion to either repair or replace the goods in question.
Where the Company is required to source or procure order-specific goods in order to fulfil the Customer’s order, a deposit of fifty percent (50%) of the total order value shall be payable.
Where cancellation is requested after order-specific materials have been procured or the product has entered production, a restocking or cancellation fee of up to twenty percent (20%) of the order value may apply to cover handling and administrative costs. You will be notified of any such charges, which will be based on the actual costs incurred up to the point of cancellation.
The Company further reserves the right to refuse any return or refund request in respect of bespoke or non-standard products manufactured to order by the Company’s suppliers. In such cases, the full deposit paid shall be non-refundable.
Defective or Damaged Goods
If the Customer notifies the Company of any issue with the goods within thirty (30) days of delivery, the Company shall, subject to availability, at its sole discretion:
make good any shortage or non-delivery;
replace or repair any goods found to be damaged or defective upon delivery; or
issue a refund for the amount paid in respect of the affected goods.
Roof Leak Exclusions
The Company shall not be liable for any roof leaks or water ingress occurring after the expiration of the one (1) year warranty period. Roof leaks arising beyond this period are expressly excluded from all guarantees, warranties, or claims. It is the Customer’s sole responsibility to ensure that the shed roof is properly maintained and inspected to prevent such issues.
Door and Window Adjustments; Wood Warping
The Company shall not be liable for any door or window adjustments, movement, or misalignment, nor for any warping, swelling, or shrinkage of timber materials that occurs more than one (1) year after delivery.
Timber is a natural product and is subject to movement due to environmental conditions, including temperature and humidity.
These changes are considered normal and expected characteristics of timber products and are therefore excluded from warranty claims beyond the initial one-year period.
Limitation of Liability
Except where required by law, our liability to you will be limited to the total value of your order. This limitation does not apply in cases of fraud, personal injury or death caused by our negligence, or your statutory rights under Irish consumer law.
The Company shall not be liable for any indirect, consequential, or business-related losses, including but not limited to loss of profit, loss of business, or interruption to business operations.
The Company shall not be responsible for any unforeseeable loss resulting from a breach of these Terms and Conditions or of its legal obligations.
Statutory Rights
Nothing in this clause shall affect the Customer’s statutory rights as a consumer, nor shall it exclude or limit the Company’s liability for fraudulent misrepresentation, or for death or personal injury caused by the Company’s negligence.
Product Specifications
All goods are sold in accordance with the manufacturer’s specifications and are subject to any instructions, representations, or qualifications included in the accompanying documentation.
Trade Customers and Indemnity
If the Customer is a trade customer, and subject to the limitation of liability clause, the Company shall not be liable to the Customer or any third party for the use or installation of goods supplied.
The trade Customer hereby agrees to indemnify and hold the Company harmless from any and all liability, claims, or allegations arising from failings in the use or installation of goods supplied under this agreement.
Base Requirements and Customer Responsibility
The Customer is solely responsible for ensuring that a suitable, solid, and level base is prepared and available prior to the scheduled delivery and installation of any garden building supplied by MCD Garden Sheds Ltd.
If the base is found to be:
uneven, sloped, unstable, or inadequate, or
non-existent upon arrival,
the Company shall not be liable for:
any delays, incomplete installations, or adjustments required to accommodate the condition of the base;
any subsequent movement, misalignment, operational issues (e.g. doors/windows not closing properly), or structural problems resulting from an unsuitable base.
In such cases, installation may be completed at the Customer’s own risk, subject to the Customer signing a Base Condition Disclaimer, acknowledging that the base does not meet required specifications and that MCD Garden Sheds Ltd assumes no responsibility or liability for any resulting issues.
Where a signed disclaimer is not provided, the Company reserves the right to refuse installation or apply additional charges for rescheduling.
Age-Restricted Goods
When placing an order for age-restricted goods (including but not limited to solvents), you are confirming that they are over the age of eighteen (18) and that delivery shall be accepted by a person of the same minimum age.
The Company reserves the right to cancel any order where it reasonably believes that the Customer is not legally entitled to purchase the relevant goods.
Termination
The Company reserves the right to suspend further supply or delivery, stop goods in transit, or terminate the contract by written notice to the Customer if:
The Customer is in breach of any contractual obligation; or
The Customer becomes unable to pay their debts as they fall due; or
bankruptcy or insolvency proceedings are initiated by or against the Customer.
Upon termination:
All amounts owed by the Customer, whether or not already due, shall become immediately payable.
The Company shall have no further obligation to supply goods to the Customer.
Force Majeure
The Company shall have no liability for any delay or failure in the supply or delivery of goods, or for any damage or defect to goods supplied, arising from any event or circumstance beyond the Company’s reasonable control, including but not limited to:
strikes;
lockouts;
other industrial disputes;
supply chain disruption;
natural disasters;
acts of government;
or other force majeure events.
General Provisions
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
This contract shall be governed by and interpreted in accordance with the laws of Ireland, without regard to any conflict of law principles.
Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Irish courts.
