MCD Garden Sheds - Terms & Conditions      

1. Our Contract      

1.1. These Terms and Conditions govern the supply of goods sold by MCD Garden Sheds of West Curragh, Naul, Co.Dublin (“we” and “us”) to the customer (“you”) and constitute the entire and only agreement between us in relation thereto. Company Reg. No: 617989, Company Vat No: 3523983QH

1.2. All orders placed by you in our online shop and over the phone are on the basis of these Terms and Conditions and are subject to acceptance by us by delivery of the goods to you at which point a legally binding contract is constituted between us. The processing of your payment and acknowledgement of your order does not constitute legal acceptance of your order.

2. Price & Payment      

2.1. The price payable for the goods you order is as set out on our website at the time you place your order, plus any charges for delivery as advised to you.     

2.2. We reserve the right to update the price of goods, from time to time but we will confirm the prevailing price with you before accepting your order. We are not obliged to accept your order and may decline it or limit the order quantity of goods sold.     

2.3. Occasionally, we advertise goods at a promotional price; you must quote the relevant promotion code, otherwise, you may be charged the full price. We reserve the right to change or remove special offer at any time, extend or reduce special offer period of time without any notice.    

2.4. Occasionally an error may occur and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price.    

2.5. We must receive payment for the whole of the price of the goods you order, and any applicable charges for delivery before your order can be processed. If you wish to order product and pay deposit please contact us directly.    

2.6. You may not withhold payment of any invoice or another amount due to us by reason of any right of set-off or counter-claim, which you may have, or allege to have.    

2.7. We shall be entitled at all times to set off any debt or claim which we may have against you against any sums due from you to us.     

2.8. The format of our invoice and statements to you will solely be dictated by us and we will not enter into any variation of our format.     

2.9. Any “Was” price displayed on the website shows the item’s previous selling price for a period of at least 30 days prior to the reduced price coming into effect unless otherwise stated.      

2.10. Once we have been informed that the installation of a pre-ordered garden building is complete any outstanding balance must be paid immediately. You must ensure that there is someone available to make the payment. If for any reason payment is not made immediately our installation team will be instructed not to leave the site and a waiting charge of €50 per hour will be added to the balance until such time that the balance is cleared. If the payment will be not made our installers will take back the item and we will cancel an order, in this situation we will not refund your deposit

2.11. In case if you change your mind and decide to cancel the order within 5 days from the date order was placed we will give you back deposit paid to us in full. If you cancel your order after 5th day but before we start production of your shed/product we refund the deposit minus 10% (Administration cost, sourcing of timber, other costs) If you cancel your order once we start manufacturing your shed/product or after your product is built we don't refund any deposit.

2.12. Below list od deposit accepted to place an order:

50% deposit accepted to order a standard garden shed

50% deposit required to order bespoke garden building & garden room

No deposit accepted for garden furniture. Garden furniture must be paid in full to place an order.

Company reserve the right to change the deposit amount at any time. Balance payments are required to be cleared in advance of delivery.


3. Specification of products & Guarantee

3.1. Our warranty does not cover damage caused to products by adverse weather conditions, wind, rain or other forces of nature, accidents improper assembly or disassembly or adjustment during setup or takedown, or any abuse, misuse or neglect by the user or third party.

3.2. MCD Garden Sheds warrants that the Goods will correspond with their specification at the time of delivery and will be free from defects in material and workmanship for a period of 12 months from the date of their initial delivery/installation.

10 years anti-rot warranty apply only to timber used to build your product.

3.3. All sizes quoted on our website or by our sales team are only for informational purposes. Because all sheds are hand-made we will do everything to match your required size as much as possible but small differences can happen. All sizes quoted are external sizes.

3.4. All pictures used on our website are for informational purposes only and are not showing “your product”. Every timber product is built according to customer specification, each time different batch of wood is used and this is why the actual colour of your product can vary from one on the picture. Please note that different devices and different screens display colours in different way depending on individual settings. We put a lot of effort to show as accurate pictures as possible. If you want to see a very specific picture of a very specific product please contact us directly and we will be more than happy to send you required pictures if we have them.

3.5. Wood is a naturally variable raw material; its variances are not within our control and are therefore not considered defects. Grain characteristics like knots, open grain and medullary rays are all naturally occurring features and will not be considered grounds for rejection by a customer

3.6. Removal of old shed is not included in our sheds prices. We may agree to remove your old shed but this service will be charged extra and offered only at Management discretion.

3.7. Building the concrete foundation, base or supplying any concrete slabs is up to the customer. Area, where shed will be installed, should be cleared, levelled by a customer. Please note that we don’t take any responsibility for any damages to sheds that installed on soft ground. Sometimes it may happen that shed will sink on soft and wet soil, this is why we always recommend building a concrete foundation.

Sheds are installed in exact place pointed by customer. If you require shed to be moved after installation is done you must contact with us to arrange suitable time. Moving shed to new place is a separate service that can be provided at extra cost.

3.8. We offer security pack with special screws, hinges and locking systems. Security pack elements are designed to “resist” to bulglary for longer time than standard hinges, screws and locking systems. Security pack don’t mean that no one will ever break-in to shed it only mean that shed with security pack is secured better that shed without security pack. MCD Home and Garden don’t take any responsibility for your losses if burglary into your shed occur even if we install “security pack”.

3.9. MCD Home and Garden is under no liability in the event that the customer in its absolute discretion makes any change to the specification of the Goods which are required to comply with any applicable safety or statutory requirement or otherwise or which do not materially affect the quality and fitness for purpose of the Goods

3.10. The Seller shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the Seller's instructions (whether oral or in Writing), misuse or alteration or repair of the Goods without the Seller's approval

3.11. MCD shall be under no liability under the above warranty (or any other warranty, condition or guarantee) if the total price for the Goods has not been paid by the due date in full.

3.12. If the Goods delivered are not the Goods ordered by the Buyer (including any substitute product) the Buyer is entitled to reject the Goods. Subject to this, any claim by the Buyer which is based on any defect in the quality or condition of the Goods or their failure to correspond with specification shall (whether or not delivery is refused by the Buyer) be notified to the Seller on the date of delivery. If delivery is not refused, and the Buyer does not notify the Seller accordingly, Buyer must pay the price as if the Goods had been delivered in accordance with the Contract.

3.13. Except in respect of death or personal injury caused by the Seller's negligence the Seller shall not be liable to the Buyer by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any consequential loss or damage (whether for loss of profit of otherwise), which arise out of or in connection with the supply of the Goods or their use or resale by the Buyer, except as expressly provided in these Conditions.


4.1. If you have notified us of a problem with the goods within 30 days of delivery, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery, or refund to you the amount paid by you for the goods in question.     

4.2. We shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. Our liability to you shall not, in any event, include losses related to any business of yours, such as loss of profits or business interruption, neither will we be responsible to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.     

4.3. This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.     

4.4. All goods are sold in accordance with the manufacturer’s specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.     

4.5. If you are a trade customer and subject to Clause 6.3, we will not be responsible to you or, in the event that you are undertaking work for another person, to any other person, for the use or installation of any goods by you. Accordingly, if you are a trade customer, you hereby agree to hold us harmless and indemnify us against any liability associated with, any claim or allegation that we are responsible for any failings in the installation or use of goods that we supply.

6. Delivery Time

6.1. All our timber products are built to order. Please note that different delivery time apply to different products. In all cases we will inform you about current delivery time. Below you will find the general guidelines of delivery time.

6.2. Garden sheds and garden buildings 3-4 weeks and up to 16 weeks in the middle of season.

Garden benched usual 4-5 working days and up to 8 weeks in the middle of the season.

Bin cover units 1-2 weeks and up to 8 weeks in the middle of the season.

All bespoke projects may require more time. Delivery times of garden buildings quoted at the time of order are estimated and so cannot be guaranteed. Whilst we will make every effort to deliver within the estimated delivery time, occasionally deliveries may be affected by factors beyond our control.

6.3. We offer “Free delivery and installation” in greater Co.Dublin area. Free delivery and installation offer can be withdrawn at any time and it is only at Management discretion to decide about area that is covered with this offer/service. In the case that your delivery/installation address is not covered by “free delivery & installation,” extra charge will apply. Delivery & Installation charge will be calculated based on the distance between our workshop and your delivery address. You will be informed about delivery charge before we accept an order.

6.5. The Seller will not accept any responsibility for any third party costs incurred for late deliveries, failed deliveries or incomplete deliveries. It is the Buyer responsibility to check that the delivery is complete and in good order before arranging any third party contractors to do any other jobs.

6.7. In all cases we contact you approx. 10 days before planned delivery to agree specific day for delivery. Once you agree with us delivery date You must do all that you reasonably can to enable delivery to take place at the given time and place. If you delay delivery, or delivery fails because you have not taken appropriate steps, we will try to arrange for an alternative delivery date within 30 days of the failed delivery. If delivery fails as a result of circumstances within your reasonable control, the cost of any re-delivery shall be borne by you. We offer delivery services Monday to Friday only. No deliveries on bank holidays.

6.8. If an installation service for a garden shed or other garden building has been requested, you must provide suitable access, and a flat, level and square base, capable of carrying considerable weight. We do not inspect the suitability of your base to support the garden building without ground movement. We do not check the integrity of the base. The site should be clear of overhanging branches or obstructions and have sufficient unobstructed access to the site for the safe erecting and maintenance of the building. If access or the base is unsuitable, you will be liable for the aborted labour costs, and the product will be left for self-assembly.

Should you require a return installation service, additional charge must be paid prior to the subsequent visit being made. You must ensure that the installer’s vehicle can be parked as close as possible to the installation site. If a parking area cannot be located nearby the site, the installation may be abandoned and a return charge may apply.   

7. Cancellation & Returns


7.1. Our 14-day returns policy apply only to products that have been ordered online and send to you with external courier company, means that if for any reason you are unhappy with your online purchase, you can return goods in original condition within 14 days of the date you received goods, unused and in original packaging with contents in the condition they were delivered, along with a receipt of proof of purchase. We will issue a refund for the price you paid for the goods only excluding delivery costs incurred by the company.  

7.2. Customers are responsible for returning goods and the costs associated in doing so back to MCD Garden Sheds. Returned goods must be unmarked and free from blemishes of any kind, the total refundable amount is dependant on goods being returned to us in the same ‘perfect condition’ that they were received in (we would advise keeping all packaging if you are considering returning an item). Please speak to a member of our customer services team for more information on cancelling an order. Providing we have received the goods back in ‘perfect condition’ with a valid returns note, refunds will be issued within 14 days of the goods arriving with us.

Refund will be issued in exactly same form as payment was made in other words we will refund money only to a card or account that was used to pay for goods.  

7.3. If a customer contacts our company after the specified 14 days, MCD Garden Sheds has the right assume that the order has progressed to completion. The customer will not have an automatic right to a refund. Refund can be provided or refused and it's solely at the discretion of the company.

7.4. If at any point you wish to cancel an order placed for any of our timber products you have right to do so. If you contact us and request cancellation before we agree on a delivery date with you and before we start production of your item we will provide you with full refund. If you contact us after a delivery date is confirmed with you and after we start production of your item your deposit will be nonrefundable. If payment has been made in full then you will only be entitled to a 50% refund, as work will have already been carried out on your behalf. However we reserve the right to refuse your request for a refund when full payments have been made when manufacturing bespoke work upon your instructions, in that case, we will assess the stage of production and provide you with refund accordingly to the stage of production your item is at that moment.



8.1. We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, any payments you owe to us (even if they are not yet  

due for payment) will be immediately due and payable and we shall be under no further obligation to supply goods to you.      

9.Force Majeure


9.1. We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).      



10.1. If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with Irish law.
